Terms of Use

These Terms govern access to and use of the Eldwick Swim Results website. Please read them before using, copying, or relying on the Site or its data.

1. Acceptance of these Terms

By accessing or using this website, including its tables, filters, charts, downloads, links, and related content (collectively, the “Site”), you agree to these Terms of Use. If you do not agree, do not use the Site. If you use the Site on behalf of another person or organization, you represent that you have authority to bind that person or organization to these Terms.

2. Independent, unofficial project

The Site is an independent informational project. It is not operated, sponsored, approved, or endorsed by the Montgomery County Swim League (“MCSL”), Eldwick Swim Team, any participating club or team, any school, or any governing body. References to organizations, teams, meets, athletes, and trademarks are for identification and informational purposes only. All third-party names and marks remain the property of their respective owners.

3. Public result data and official records

The Site reorganizes and visualizes swimming results obtained from publicly accessible meet-result sources. The Site displays age groups rather than athletes’ specific ages, together with athlete names, team or relay membership, events, times, placements, points, and meet information. The Site Operator does not claim ownership of third-party source records.

The Site is not the official record. Results may be incomplete, delayed, transcribed incorrectly, later corrected, or affected by differences in scoring and relay-attribution rules. The applicable official meet record controls in every case. Users should verify important information against the original source before relying on it.

4. Permitted use

You may use the Site for lawful, personal, family, educational, journalistic, historical, or noncommercial research purposes. Limited sharing of links, screenshots, and chart images is permitted when it is accurate, respectful, does not remove source or context, and does not imply official endorsement.

5. Prohibited conduct

You may not use the Site or its data to:

  • harass, stalk, threaten, shame, exploit, or discriminate against any athlete, parent, volunteer, coach, official, or team;
  • identify, locate, contact, profile, advertise to, or commercially solicit a minor;
  • combine Site data with addresses, contact details, precise location, school records, health information, credentials, or other sensitive information to create profiles about individuals;
  • publish misleading comparisons, impersonate another person, misrepresent affiliation, or present the Site as an official source;
  • scrape, crawl, query, or access the Site in a manner that imposes an unreasonable load, circumvents technical controls, or interferes with availability or security;
  • introduce malicious code, probe vulnerabilities, attempt unauthorized access, or use the Site for unlawful activity; or
  • copy, sell, sublicense, or commercially exploit the Site’s original design, software, charts, text, or compilation without permission, except as allowed by law.

6. Minors and responsible use

The Site is intended for a general audience and is not designed to collect information directly from children under 13. Competition records displayed on the Site may concern minors. Parents, guardians, coaches, and other users are expected to use that information responsibly and only for legitimate purposes. A child should use the Site only with permission and supervision from a parent or legal guardian.

7. Corrections and removal requests

If you believe a displayed record is inaccurate, improperly attributed, or creates a genuine safety or privacy concern, you may ask the Site Operator to review, correct, limit, or remove it. When the underlying official record is wrong, you should also contact MCSL or the relevant team or meet administrator because a change on this Site does not alter the official source.

Requests should identify the record, explain the concern, and provide enough information to verify authority to act for the affected person. The Site Operator may request reasonable verification, may preserve information when legally required, and may decline requests that are fraudulent, abusive, unverifiable, or inconsistent with law. If you do not have a direct communication channel to the Site Operator, ask the relevant Eldwick team administrator to forward the request.

8. Intellectual property

Subject to rights in third-party source material, the Site’s original software, visual design, explanatory text, chart presentation, and original selection or arrangement of content are owned by or licensed to the Site Operator and are protected to the extent allowed by law. No license is granted except the limited permission to use the Site under these Terms. Nothing in these Terms restricts rights that cannot lawfully be restricted, including applicable fair-use rights.

9. Third-party sources and links

The Site links to third-party sources for convenience and verification. The Site Operator does not control and is not responsible for third-party content, availability, security, privacy practices, or later changes. A link does not imply endorsement or affiliation.

10. No warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, TIMELINESS, TITLE, NON-INFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SECURITY, OR UNINTERRUPTED AVAILABILITY.

The Site is not intended for medical, safety, eligibility, disciplinary, recruiting, wagering, or other high-stakes decisions. You assume all risk arising from your use of or reliance on the Site.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE OPERATOR AND CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOSS OF DATA, LOSS OF REPUTATION, LOST PROFITS, OR CLAIMS ARISING FROM ACCESS TO, USE OF, INABILITY TO USE, OR RELIANCE ON THE SITE OR THIRD-PARTY SOURCES.

To the maximum extent permitted by law, the total aggregate liability of the Site Operator and contributors for all claims relating to the Site will not exceed one hundred U.S. dollars (US $100). Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.

12. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless the Site Operator and contributors from claims, losses, liabilities, damages, judgments, costs, and reasonable legal fees arising from your unlawful use of the Site, misuse of information about another person, violation of these Terms, or infringement of another person’s rights.

13. Changes, suspension, and termination

The Site Operator may correct, change, restrict, suspend, or discontinue any part of the Site at any time, including to protect athletes, comply with law, address security concerns, or preserve resources. Access may be blocked for conduct that violates these Terms. Updated Terms become effective when posted with a revised effective date; continued use after that date constitutes acceptance of the updated Terms.

14. Governing law and venue

Except where applicable law requires otherwise, these Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law rules. Any dispute that is not resolved informally will be brought exclusively in a state or federal court with jurisdiction in Montgomery County, Maryland, and each party consents to that jurisdiction and venue.

15. General provisions

These Terms and the Privacy Notice are the entire agreement concerning use of the Site. If a provision is held unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will remain effective. Failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without written permission; the Site Operator may assign these Terms in connection with operation or transfer of the Site.

16. Contact

Questions, legal notices, and correction or safety requests should be sent through the communication channel by which the Site was provided to you. If no direct channel is available, contact the relevant Eldwick team administrator and ask that the request be forwarded to the Site Operator. Official-result corrections should also be directed to the original results publisher.
